Must a person always sign the document in my presence?

 

If the document is an affidavit or other document requiring an oath, then the person MUST sign it in my

presence.

 

If the document is an acknowledgment, then the person need not sign it in front of me BUT MUST PERSONALLY APPEAR before me and acknowledge execution of the document.

  

What is the difference between an acknowledgment and an oath?

 

In an oath or affirmation, a person swears to the truth of statements made.

 

In an acknowledgment, a person is not swearing to the truth of statements, but is confirming that the document was voluntarily signed by him/her, and that he/she understood the nature and purpose of the document.

  

May I get my signature on documents notarized on Sunday?

 

YES. There is no section of the Wisconsin Statutes that makes it unlawful for a notary act on a Sunday or any holiday.

Can a notary help me prepare the documents that I need notarized?

 

NO, unless the notary is also an attorney licensed to practice law in Wisconsin. A Notary Public who is not an attorney may not engage in the practice of law, which includes the preperation of legal papers, such as wills, contracts, deeds, power of attorney, etc.

 

What exactly is a Notarization?

 

A "notarization" is more precisley called a "notarial act". "Notarial act" means any act that a notary public is autorized to perform, and includes taking an acknowledgment, administering an oath or affirmation, taking a verification upon oath or affirmation, wittnessing or attesting a signature, certifying or attesting a copy and noting a protest of a negotiable instrument. [A Notary Public may not certify a VITAL RECORD. That can only be done by the official custodian of the document.}
